SICOM Systems, Inc. (“SICOM”, “we”, “our” or “us”) is committed to protecting the privacy of those who entrust us with their personal information. Our employees, and all those who do business with us, trust and expect that we will protect their personal information in accordance with the promises we make. “Personal information” means any information or set of information that identifies or can reasonably be used to identify an individual. It does not include information that is encoded or anonymized, or publicly available information that has not been combined with non-public personal information. This Privacy Policy details our commitment to your privacy.

In furtherance of our commitment, SICOM complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information from European Union member countries and Switzerland. SICOM has certified that we adhere to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access and enforcement, as described in this Privacy Policy.

We are currently working to confirm and certify compliance under the successor EU-U.S. Privacy Shield (“Privacy Shield”), as set forth by the U.S. Department of Commerce and the European Commission, regarding the transfer, collection, use and retention of personal data made to U.S. organizations from the Member States of the European Economic Area (“EEA”), which includes the 28 EU Member States plus Norway, Iceland and Liechtenstein.


1. What does this Privacy Policy cover?

SICOM is headquartered in Doylestown, Pennsylvania, and is dedicated to the research, design, development, manufacturing, marketing and service of hardware, software and services solutions within the global restaurant industry relating to point-of-sale (“POS”), digital signage, enterprise management, kitchen management, drive-thru management, data warehousing, business intelligence and analytics, employee training and customer loyalty (our “Customers”). This Privacy Policy describes our privacy practices regarding personal information we receive in connection with the services and products we provide to our Customers.

By using our services, visiting our websites or portals or otherwise interacting with us, you are accepting the practices described in this Privacy Policy. We recommend that you review this Privacy Policy periodically, as it may be updated from time-to-time.


2. What information does SICOM collect?

Information that our Customers give us:

  • We may collect personal information, such as name, address, credit card information, email address and phone number from our Customers’ guests through our POS systems or other services;
  • We may collect personal information, including without limitation name, address, phone number, email address, government identification number, time and attendance, employment eligibility, tax withholding and other information of our Customers’ employees in connection with our enterprise management solutions and systems; and
  • We may collect personal information from our Customers’ employees when they contact our customer service representatives or otherwise interact with us, including without limitation through www.sicom.com or other websites or online services or portals sponsored by us (the “Sites”).

SICOM does not own the data collected and does so at the request and convenience of our Customers and their brand franchisors. Customers are responsible for complying with all notices, notifications and alerts to individuals whose information is entered into our systems or portals. In all cases, if we are collecting data on behalf of a Customer, that Customer is required to provide any required notification to its employees, agents or guests to the extent their personal information may be included in our services.

Information we collect automatically:

When you visit the Sites, we may use “cookies” or similar technology to automatically collect certain information, including without limitation:

  • Your Internet protocol (IP) address, MAC address or other device identifier;
  • The kind of browser or computer you use;
  • The number of links you click within the Sites;
  • The state or country from which you accessed the Sites;
  • The date and time of your visit to the Sites;
  • The name of your Internet service provider;
  • The web pages you linked to our Sites from; and
  • Pages you viewed on the Sites.

A “cookie” is a small piece of information that a website, online application or email may save to your browser or your computer’s hard drive for use in subsequent visits to the website or online application. The “help” portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive new cookies or how to disable cookies altogether. If you reject cookies, you may not be able to participate in certain activities or receive a promotion tailored to you. SICOM does not control and does not guarantee the effectiveness of browser-based tools for managing cookies.

SICOM does not currently participate in interest-based or behavioral online advertising, and information automatically collected from the Sites is not used by SICOM for that purpose. SICOM may use Google Analytics to evaluate use of the Sites for our internal purposes such as evaluating usages of the Sites. Additionally, if you are subscribed to any of our services, we will track:

  • Your login ID; and
  • Any changes, edits, or alterations made via the SICOM-hosted web application.

Any and all personal information collected on the Sites will be kept strictly confidential and will not be sold, reused, rented, disclosed or loaned to third parties, except as otherwise described in this Privacy Policy.

Do Not Track (DNT): This is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium, or W3C, has not yet established universal standards for recognizable DNT signals, and therefore SICOM and the Sites do not recognize DNT.


3. How does SICOM use personal information?

We may use your personal information for a variety of purposes, including without limitation:

  • Delivering our services and Sites to our Customers;
  • Processing and completing Customer POS transactions;
  • Responding to Customer requests;
  • Evaluation of our services and Sites to improve, tailor and better serve our Customers;
  • Verifying and validating the identity of Customer employees or Customer guests;
  • Keeping a record of our interactions with our Customers if you place an order or otherwise deal with our representatives over the telephone or online; and
  • Preventing, investigating or providing notice of fraud, unlawful or criminal activity or unauthorized access to or use of personal information, the Sites or data systems or to meet legal obligations.

4. How does SICOM share personal information?

With our Business Partners: Personal information collected by SICOM may be shared with our business partners and used in accordance with this Privacy Policy and subject to contractual requirements that such information be maintained in a confidential and secure manner.

With our Service Providers: SICOM may share personal information with our service providers. Some examples of things that service providers do that may involve your personal information include:

  • Developing, hosting, and maintaining the Sites and providing certain services on our behalf;
  • Authorizing of credit card and other financial transactions for our Customers and their guests; and
  • Aggregating and/or analyzing personal information in order to help deliver the Sites and services to our Customers.

In all cases, our business partners and service providers will be contractually limited in the way they may use personal information maintained by SICOM, including requirements that such information be maintained in a confidential and secure manner.

As directed by our Customers: Depending on our Customers’ instructions, SICOM may also share certain personal information with the relevant brand franchisors or their affiliates, subject to contractual requirements that such information be maintained in a confidential and secure manner. Customers have been advised by separate communication that SICOM is headquartered in the United States and that data collection facilities may be hosted in the United States or other locations. If a Customer requests the Sites or services to process, transmit or store any personal information, as that term may be defined by applicable law, the Customer (i) agrees to limit such use to the minimum necessary for management of its operations and (ii) agrees to comply with all requirements of directives, laws, or regulations.

In Connection with Business Transfers: In the event that a division, a product or all of SICOM is bought, sold or otherwise transferred, or is in the process of a potential transaction, personal information will likely be shared for evaluation purposes and included among the transferred business assets, subject to contractual requirements that such information be maintained in a confidential and secure manner.

To Comply with Laws: SICOM may also disclose specific personal information when such disclosure appears necessary to comply with the law, a subpoena or other litigation process or to protect the interests or safety of our Customers, our Customers’ employees or others.


5. How does SICOM protect personal information?

SICOM uses industry-standard technology on the Sites and in connection with our services to help protect personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction. Personal information received from our Customers or others in connection with the Sites or services is stored on servers that SICOM has attempted to secure from unauthorized access or intrusion. “Secure Socket Layer” (SSL) and “Transport Layer Security” (TLS) technology protocols are used to encrypt personal information transmitted to SICOM through the Sites and in connection with our services.


6. What are my choices concerning my personal information?

SICOM depends primarily on our Customers to notify and offer their guests and employees choices regarding the personal information that they provide. To the extent personal information is disclosed to a third party or used for a purpose other than as disclosed in this Privacy Policy, SICOM—either through our Customers or directly—will give an individual the ability to opt out.

We do not sell, rent, or share the personal information of our Customers’ employees or their guests with third parties for their own marketing purposes. SICOM may use personal information from our Customers and their employees to contact them about our Sites and services, including to provide them with information on additional products from SICOM that may be of interest to them. In addition, as part of the services, our Customers may use personal information that we have collected on their behalf for their own communication and promotional purposes.

SICOM will provide individuals with reasonable access to personal data about them and they may request to no longer receive communications from SICOM and/or the correction or amendment of personal information that they demonstrate to be incorrect or incomplete. To make such a request, please feel free to contact us as described below. If the personal data was collected by our Customer, we will promptly communicate your request to our Customer.


7. How is this Privacy Policy enforced?

SICOM has put in place mechanisms to monitor and verify our ongoing adherence to these privacy principles. We encourage individuals covered by this Privacy Policy to raise any concerns that they have about the way that we process their personal information by contacting SICOM as described below. We take your questions and concerns seriously, and will do our best to resolve them. We have also agreed to participate in the dispute resolution program provided by the European Data Protection Authorities Panel and to cooperate and comply with the Federal Data Protection and Information Commissioner of Switzerland.


8. What is SICOM’s policy on children’s privacy?

SICOM and our Sites and services are not directed toward children and we do not knowingly solicit or collect personally identifiable information online from children under the age of 13 without prior verifiable parental consent. If SICOM learns that a child under the age of 13 has submitted personally identifiable information online without parental consent, we will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). If you become aware of any personally identifiable information we have collected from children under age 13, please contact us as described below.


9. Your California Privacy Rights

This Privacy Policy describes how we may share your information for marketing purposes, as described above. California residents are entitled to request and obtain from us once per calendar year information about any of their personal information shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information. To request this information and for any other questions about our privacy practices and compliance with California law, please contact us as described below.


10. Transfer of personal information to the United States

This Privacy Policy sets forth how SICOM handles personal data transferred to the United States from our Customers and their employees and/or guests located in countries in the EEA and Switzerland. It also covers personal data that may be provided relative to sales queries or visitors to the Sites. As noted above, SICOM complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework and is currently working to confirm and certify compliance under the Privacy Shield.


11. Changes to our Privacy Policy

If we change our Privacy Policy, we will post those changes on the Sites and/or update the Privacy Policy modification date below. In certain cases, we may also notify our Customers regarding changes to our Privacy Policy directly by email or otherwise.
